Update on Labor Certification Processing in Texas

The state labor agency, the Texas Workforce Commission (TWC) has advised the State Bar of Texas Committee on Laws relating to Immigration and Nationality which in turn has made the information available to the American Immigration Lawyers Association that it has lost several experienced analysts resulting in additional delays in processing Labor certification applications.

TWC now takes 12 months from the date of submission of a labor certification application for that application to be reviewed by an analyst. Based on the advice of TWC, the Law Office of Sheela Murthy recommends use of reduction in recruitment (RIR) in appropriate cases, because RIR cases are generally processed more quickly. Unlike in some States, there is no list of particular types of positions which are acceptable for RIR in Texas. Any type of job can qualify, provided the employer shows sufficient recruitment activity to satisfy the pattern of recruitment as enunciated in GAL I 97.
