National Interest Waiver Approval for Environmental Scientist

In June 2000, The Law Office of Sheela Murthy received an approval from the
INS for a National Interest Waiver petition filed on April 6, 2000. The
beneficiary, an Environmental Chemist who specializes in the areas of Soil
Science and Water Treatment, has a Ph. D. in Environmental Science, an M.S.
degree in Chemical Engineering, a Masters degree in Business Administration,
and a Bachelors degree in Chemical Engineering.
The approval was based on strong arguments propounded by the Law Office of
Sheela Murthy, emphasizing that the beneficiary is a professional with an
impressive background in both microbiology and geochemistry. This background
is needed, we explained, to understand complex vital interactions among
minerals, surfactants, and organic matter in the earth’s subsurface.
The beneficiary’s work was shown to advance our nation’s environmental
conservation capabilities by accurately predicting the crucial factors for
effective measures against serious outbreaks of waterborne disease.
Additionally, it was argued that his work directly benefits U.S. healthcare,
our environment, and our economy, and enables compliance with U.S. federal
laws.
Supporting documentation included evidence of the beneficiary’s education,
experience, prizes/awards, original scientific/scholarly contributions in
his field of expertise, authorship of scholarly articles in the field in
professional publications, presentations at internationally renowned
conferences, and memberships in professional associations.
It is interesting to note that petitions filed at the Texas Service Center
are now taking only 60 to 90 days. TSC is processing recent cases more
quickly but continues to hold on to earlier filed petitions. Nebraska has
also shown a marked improvement in processing time. Some I-140 petitions at
other centers are taking at least ten months, often over a year.
