"E" Work Authorization Update

In our February 8, 2002 article, E and L Spouse Work Authorization Guidance, we reported that the INS had started taking applications for work authorization filed by E and L spouses. The INS Vermont Service Center has updated its instructions regarding work authorization filings for both E-1s and E-2s.

According to the most recent announcement, issued February 12, 2002, the Vermont Service Center (VSC) has modified its earlier position about requiring E spouses to file their I-765s at that Service Center. VSC will accept Applications for Employment Authorization (I-765) for E-1/E-2 applicants that are filed independently of the principal application for E status. This is, of course, limited to individuals who live within the VSC's jurisdiction.

The VSC will reject I-765s that are filed concurrently with the principal application for E status (filed on form I-129). These filings must be filed with the Texas Service Center.
