Processing of H1B cases for FY2001 Cap

The Immigration and Naturalization Service (INS) announced, on or about
August 9, 2000, that they had begun processing the H1B cases for fiscal year
2001 -- those H1B Petitions which request a start date of October 1, 2000.
As of August 15, the INS Service Centers announced that they were working on
cap cases filed as of the dates indicated below:

We
at The Law Office of Sheela Murthy, P.C. can confirm that we have begun to
receive approvals for the October 1, 2000 cases. In looking at the dates
above, readers will note significant variation from one Service Center to
another.
As we have noted in articles in earlier issues of the MurthyBulletin,
INS Service Centers were required by INS Headquarters to keep a uniform pace
for processing last year's cap cases (for FY2000, October 1, 1999 to
September 30, 2000). This mandate was a source of frustration to many,
because it meant that Centers that were processing cases more quickly had to
slow down. For now, INS says that Centers can progress through their FY2001
caseload "at their discretion." Consequently, further disparities
may develop in processing times.
Since H1B processing issues are of great interest to most of our readers,
you can expect to see further updates in upcoming issues of the MurthyBulletin
as more information becomes available.
