INS Establishes New Adjudication Priorities

The Immigration and Naturalization Service (INS), in an effort to provide its customers with consistent service and expectations, has established new adjudication priorities for all of the INS Service Centers. Of course, as is expected, the INS advises us that the processing dates below are only goals. At present, as stated in previous issues of the MurthyBulletin, the Service Centers are generally taking longer than listed below, to process most cases.

The INS hopes that all of its other applications/petitions should be completed within 180 days. Specific target processing times for the last two items listed above, I-485 (adjustment of status to permanent residence) and N-400 (naturalization) vary depending upon the location, since INS believes that certain localities have a disproportionate number of cases. Further information on processing targets for these two case types is likely to be forthcoming from INS shortly.

Certain case types are notably absent from the above list. For example, Form I-824, which is used for a variety of purposes, including but not limited to (a) sending cable notifications on approved cases to consulates abroad and (b) obtaining duplicate approval notices, should logically be a priority. An I-824 requests a relatively simple action on a case that has already been approved, to enable the beneficiary or a derivative beneficiary (i.e. family member) to complete the processing of the case. The INS has stated that they understand the urgency of the I-824 Application but that they cannot provide a time frame or goal for that Application at this time!
