DOS Cable on NIV Photo Requirements

The U.S. Department of State (DOS) recently issued a set of instructions for
the consulates with regard to the quality of photographs submitted for
nonimmigrant visa applications. We include this information in the MurthyBulletin and on MurthyDotCom
in the knowledge that many of our readers and their family members apply for
tourist, student, H1B, and other nonimmigrant visas at the consulates.
Accordingly, they will need to comply with the current photograph
requirements.
The DOS cable message begins by citing the instructions already indicated in
the Foreign Affairs Manual, which is the DOS guidebook for consulates. Those
instructions indicate that the photo must be a full-face photo (as opposed
to the three-quarter view used for INS photos) about one and a half inches
to two inches square, with a light, solid color background. The photo should
show the face clearly. A religious head covering is allowed, as long as the
face is not covered.
The cable also explains that only religious head coverings are allowed -- no
work-related, ethnic, or tribal hats or headgear. The face must be
completely visible. If, however, the applicant does not wish to show his/her
ears for religious reasons, it is acceptable for the ears to be covered. DOS
reserves the right to change the photograph requirements from time to time,
and will inform consulates accordingly.
Although not mentioned in the DOS cable, we at The Law Office of Sheela
Murthy believe that these photograph requirements are subsequent to the
September 11, 2001 attacks. Full frontal photographs may help in the
identification of suspected terrorists. Sophisticated, new technology more
easily enables photographic identification as features are picked up despite an individual’s
efforts to alter her/his appearance.
