Recent Example of an NIW Approval at LOSM

The Immigration Act of 1990 provided, for the first time, a National Interest Waiver (NIW) or an exemption from the Labor Certification process for those who possess an advanced degree or are of exceptional ability and whose work benefits the U.S. as a whole in the national interest. From time to time in the MurthyBulletin, we have presented examples of successful NIW petitions filed by the Law Office of Sheela Murthy. Here is another recent example of our continued success in this field - even after the stringent NYSDOT criteria imposed since late 1998, which have been described in issues of the MurthyBulletin in late 1998 and early 1999.

In April of 2000, the Law Office of Sheela Murthy submitted an NIW Petition for a professional with an advanced degree in Instructional Science and Technology. The Candidate is an internationally known expert in the burgeoning field of Multimedia, defined as “an integration of audio, video, graphics, animation and text on an interactive computing platform for the purpose of communication.” We argued that this professional enables the leaders in U.S. education and industry to make the leap to the 21st century through her innovations in Multimedia and Instructional Technology. The INS agreed with the arguments we presented and approved the NIW Petition submitted in August 2000, without even a request for further evidence, as they are often known to issue since NYSDOT.

The various reference letters attested to the Candidate's extraordinary contributions to the field of higher education, to the Multimedia and Web Design profession, and to the economic well being of the nation. We at the Law Office of Sheela Murthy argued that the Candidate's new approaches to online education enable the U.S. to cope with the demand for trained professionals. Her innovations have been incorporated into course designs by universities around the world seeking to expand their distance learning programs. The Candidate's students have gone on to take up responsible positions in the New Media industry as Multimedia/Web Developers and Project Managers with leading companies. Through her continued work she is developing the first generation of leading experts in a field which will blend economic, academic, and technological human wisdom in an unprecedented manner.
We also highlighted her contributions as a volunteer, co-ordinating community service events that invite participation by non-governmental and non-profit organizations. Students, staff and faculty work with these organizations in creating Internet sites for them and providing instruction on how to make effective use of these sites. Thus we demonstrated that the Candidate was instrumental in improving the quality of education and programs available to U.S. children and under-qualified workers.

This expert's work, which also includes publications and presentations, furthers the technological leadership of the United States in education, commerce, and electronic information.
