NSC Yellow Form for I-485 Inquiries

The Law Office of Sheela Murthy has often been asked if a status follow-up can be undertaken on cases pending before the INS Service Centers, especially for I-485 applications which have been taking several years. Recently, the NSC has developed a standard request form which can be printed on yellow paper for use with Employment Based I-485 adjustment cases that have been pending with the NSC for over one year.

The new form on yellow paper is sometimes attached to the notification for fingerprinting sent by NSC. These requests are not considered formal Requests for Evidence but are used for confirmation of employment with the sponsoring employer or to reiterate the offer of permanent employment with the sponsoring employer. It is possible to file the yellow sheet request to NSC for processing the case or simply wait for them to request employment confirmation from the applicant. NSC requires that only the post office box address for the Center be used as set forth on the yellow form and NOT the general correspondence address.

The NSC has been processing I-485 applications received in August 1998 (as of Dec. 31, 1999). The NSC advises that if the EB I-485 application has not been pending with them for at least 1 year there is no benefit to using the yellow employment confirmation form.
