Advanced Degree Cap - 80% Used by July 11, 2006

The U.S. Citizenship and Immigration Services (USCIS), once again has
provided an update of the H1B cap count for those applying under the U.S.
master's degree or higher education exemptions under the Fiscal Year (FY)
2007 quota. This latest count reflects usage through July 11, 2006. As of
that date, 15,208 H1B petitions had been filed against the cap. This
represents approved cases as well as those that are pending at the USCIS.
Additionally, the USCIS estimates that another 800 cases requesting the
advanced degree exemption have been filed and are awaiting the processing of
USCIS receipts. The total of these two groups of cases is 16,008 of the
permitted 20,000 exemptions, or approximately 80 percent of the H1B quota
for FY2007.

As with the last count, there is no information on cases that were received
but not yet sorted. We therefore do not know if there are any such cases, or
if sorting is moving faster than before. This most recent cap count reflects
an increase of 1059 cases since the last count, which was on July 6, 2006.

We at the Murthy Law Firm continue to advise those with potential
advanced-degree cases that they need to file these before the H1B numbers
run out. The good news is that, as of this writing, there has not yet been
an announcement that the cap has been reached. Clearly, however, this will
not be the case for much longer, given the rate of H1B filings under this
exemption. We continue to closely monitor this situation and will provide

information is released.
