Posted Jan 26, 2007

The U.S. Department of Labor (DOL) has changed its Public Disclosure System (PDS) for labor certification cases pending at the Backlog Processing Centers (BPCs). The information available at the BPCs now includes case type. The cases are designated at the BPCs as either Reduction in Recruitment (RIR) or Traditional Recruitment (TR). The DOL has issued instructions as to how to request correction of this categorization if it is incorrect. For more information on the PDS system, as well as a link to the case information, see our September 22, 2006 MurthyBulletin article, DOL Provides Online Status at BPCs, available on MurthyDotCom.

Correct a Case Type Error

If the PDS system displays a case type that is incorrect, the employer, or the employer's representative, should eMail the particular BPC at the general mailbox address. The eMail address for the Philadelphia BPC is info@phi.dflc.us; the Dallas BPC's eMail is info@dal.dflc.us. The subject line of the eMail must read "Incorrect Case Type" and must provide the case number. The body text of the eMail should explain why the employer believes the information to be incorrect. Appropriate supporting documents should be attached in <.pdf> format.

Timing for DOL Response is Uncertain

Once the eMail is transmitted, the BPC will review the case and will reply. The time it will take to receive a reply will depend upon the number of inquiries. The same is true for the time it will take for the correction to be made.
