CSC Processing Update on TSC/NSC I-130 Cases

As regular MurthyDotCom and MurthyBulletin readers know, the
California Service Center (CSC) announced in early August 2004 that it would
process new I-130 petitions for family-based cases from the Nebraska (NSC)
and the Texas (TSC) Service Centers. For more this original announcement,

The CSC provided additional information August 25, 2004 regarding this new
procedure and the cases that it will process. CSC plans to process some
pending I-130 petitions that have current priority dates from the TSC. These
include both immediate-relative cases and some I-130-preference cases for
which the priority date is current.

The CSC will issue receipt notices for new I-130 filings (I-130 filings that
never had receipt notices) from the NSC and the TSC. The CSC has warned
those who file such petitions not to file them directly with the CSC,
however. Cases should still be filed with the service center having proper
jurisdiction. The transfer of the files is an internal USCIS matter that
does not change the proper location to initially file a case. The service
centers will be responsible for identifying and forwarding the files to the
CSC. Cases filed directly at the CSC, that should have been filed at the TSC
or NSC, may be rejected outright or significantly delayed.

The cases filed with the TSC that already have receipt notices will receive
transfer notices if they are forwarded to the CSC. Once the cases are
transferred, the CSC processing times will apply to these I-130 cases. It is
possible, however, that some cases transferred from the TSC to the CSC may
be from a date earlier than the reported processing times at the CSC. The
CSC has indicated that, while it is working hard to process these cases
quickly, they will not be able to process them instantaneously. Therefore,
they have asked that those with pending I-130s give them a reasonable period
to process the cases before sending status inquiries.

The CSC expects that the transfer and adjudications of cases from the NSC
will be a temporary measure. The TSC adjudications by CSC may be more long
term in nature. We will continue to monitor developments in this area and

readers as things unfold.
