H1B Numbers
for FY2007 Available - April 2006 Update

The U.S. Citizenship and Immigration Services (USCIS) provided an update on
the Fiscal Year (FY) 2007 H1B cap numbers under the FY2007 quota. As of
April 24, 2006, only 12,713 regular cap-subject cases had been filed against
the annual quota of 58,200 cap numbers. Additionally, 2,358 advanced degree
cap-subject cases had been filed against the 20,000 available advanced
degree exemptions for those with U.S. masters' degrees or higher education.
(The regular cap is actually 65,000, but 6,800 numbers are set aside under
Free Trade Agreements with Chile and Singapore.)

The regular cap-subject cases have been filed at a rate of approximately 529
cases per day. At this pace, the USCIS expects the numbers to last until
August 2006. It is impossible to predict when the cap will be reached,
however. Once the current class of international students graduates in May
and June 2006, the volume of case filings is likely to increase. The
Master's Cap cases have been filed at a rate of approximately 98 cases per
day. The Master's Cap is expected to last until November 2006. The same
caveat, that graduations may increase the volume, also applies in the late
summer and fall each year.
