NSC Closed on March 20, 2006 Due to Bad Weather

The Nebraska Service Center (NSC) was closed on March 20, 2006, as the result of a heavy snowstorm in the area. Packages that should have been delivered on March 20, 2006, therefore, were not received until March 21, 2006.

There likely were packages scheduled to be delivered on March 20, 2006 that had deadlines on that date. These might include responses to Requests for Evidence (RFE) or Notices of Intent to Deny / Revoke (NOID/R), appeals, and regular filings all needing to be received by that day. The NSC intends to credit these packages as having been delivered timely, as long as there is proof that delivery was scheduled for March 20, 2006. The NSC has requested that they not be contacted regarding these packages until they have made their own determination as to which packages should be treated as though they "would have been delivered on March 20, 2006."

We at the Murthy Law Firm appreciate the NSC's willingness to accept these packages, since it was through no fault of the NSC, or of those sending packages, that they arrived late. There always is the chance that a mistake will be made, however. For this reason, we generally recommend that, when possible, packages be sent to the appropriate service center at least a week before the due date, avoiding questions of timeliness when something unexpected occurs. Individuals with cases affected by the weather-related closing on March 20th may wish to print this article, should they ever need to document that they did not make a late filing.
