PERM Data Entry Now Has Warnings

The U.S. Department of Labor (DOL) has recently made some changes in the data entry process used for the electronic filing of PERM labor certification cases. These do not alter the substance or processes connected to PERM cases. When certain typical case problems appear, warning messages have been added. These changes may be the result of certain recent court rulings against the DOL. We at the Murthy Law Firm are nonetheless pleased, since they help employers, employees, and the DOL in the long run. It should be noted that the DOL prefers and recommends the use of electronic filings for labor certifications.

Warnings Should Reduce Errors

The warnings are designed to reduce case rejections due to typographical errors and inadvertent omissions. One example is a warning that appears if a calendar date that is a Monday is entered under a question asking for the starting date of a newspaper advertisement, if the advertisement should have a starting publication date that is a Sunday.

Errors Can Be Fixed

Instructions are available for going back to correct typographical errors before submitting a case. It is also possible to bypass the warning and move forward without changes, if no changes are desired by the employer. The warning notices appear at the end of the sections, some of which include multiple steps. Thus, if information is provided and no warning appears, it may still mean that a warning will pop up at the end of the particular step in the 12-step PERM application.

Warning System Helpful

The warning system should prove helpful in avoiding the denials of cases simply based on typical typographical errors. PERM cases are time-sensitive, due to the limited validity of recruitment efforts and prevailing wage requests. A method for detecting typographical errors before cases are submitted, therefore, is invaluable. Of course, this does not eliminate the need to be careful in the preparation and submission of PERM filings.
