Premium Processing Form Revised

The USCIS has issued a revised Form I-907, Request for Premium Processing. This new edition, released in early February 2005, is dated October 15, 2004. This version can be used immediately. As a transitional grace period, the old version of Form I-907 can be used until September 30, 2005. The old version is dated May 16, 2001.

The Premium Processing Program has been in use since June 2001. The premium processing Form is used to obtain expedited review of many types of employment-based, nonimmigrant cases. These cases are primarily those filed using Form I-129 and include the following case types: E-1; E-2; H1B; H2B; H-3; L-1; O-1; O-2: P-1; P-3; Q-1; TN extensions; and R.

The changes in the Form are primarily within the section pertaining to the individual making the request for premium processing. In the prior version, there were three possible choices from which to select. These were: "you are the person named in the related petition / application; you work for the company / business named in the relating petition / application; and you are an attorney / representative." There are now four possible choices, including one each for the petitioner or for the beneficiary / applicant in the underlying petition and one each for the attorney for the petitioner or for the applicant. The instructions specify that the beneficiary (i.e., the foreign national) cannot sign the form to seek Premium Processing Service.

There is also an additional space to provide the petition / application number of the case for which premium processing is sought. This would be used when a case is initially filed without premium processing. Those unsure of filing fees or with questions about which versions of a particular form are acceptable for filing, can verify this information by going to the Forms Section of the USCIS WebSite.
