Rumors of Increase in H-1 Cap Not Accurate

At The Law Office of Sheela Murthy, P.C., we have been receiving many
inquiries about purported increases in the H1B cap. Most of the questions
surround the availability of 15,000 more numbers and/or numbers available
for persons with Master's degrees or above. Many of those who have contacted
us on this issue report having read about it in the Indian press. We want to
clarify that, as of this writing, there has been no change in the H1B cap.
There are efforts to make changes, including proposed legislation that is
the subject of articles that we located in the Indian press. The articles we
reviewed correctly represent that the changes are proposals only at this
stage, and are not the law in the United States. There may be a limited
number of H1Bs available for this fiscal year, based on employer revocations
of H1Bs, once the USCIS releases this information.

With the H1B cap having been reached on the first day of the 2005 fiscal
year (October 1, 2004), the need for an increase in H1B numbers should be
clear to all. United States businesses need additional members of the
professional workforce from abroad, and their need will fuel efforts for
