The following are a few abstracts of National Interest Waiver cases that were submitted by the Law Office of Sheela Murthy and approved by the appropriate Immigration Service Centers. Our Office has been very successful in obtaining approvals of such Petitions. Although the Office has filed and obtained approvals for many cases for different professionals, we have included as examples, a few case abstracts to show the range of professions covered and to indicate the nature of documents required to be submitted in such a case. The Beneficiary's work focuses on retrieving information which involves disposal of radioactive waste. The beneficiary's expertise will assist scientists in finding a safe and suitable environment to store radioactive material, which, if disposed in an unsuitable environment, could cause health hazards. The information retrieved by the beneficiary will also help scientists to collect and analyze detailed environmental and geologic data from aboveground and from underground improving the health care and welfare of the United States.

Physics Researcher :
Development of Organic Superconductors

The INS recently approved a National Interest Waiver for a Condensed Matter Physics researcher in Virginia. The beneficiary, who specializes in Condensed Matter Physics research, has a Ph.D. in Physics, and a B.S. in Electrical Engineering.

The beneficiary's research into high field magnetometry is invaluable to the development of organic conductors and superconductors in the molecular computer field. The arguments submitted were that the beneficiary s work in this field, with his inventions of new magnetic measurement technology, would advance the computer industry in the US National Interest arguments included the improvement of the economy based on cutting edge technological advances; and financial benefit to the US economy by transfer of this new technology to industry.

Computational Fluid Dynamics

The INS recently approved a National Interest Waiver petition for an aerospace Engineer in Pennsylvania. The beneficiary, who specializes in computational fluid dynamics and heat transfer, has a Ph.D. in Mechanical and Aerospace Engineering; an M.S. in Mechanical and Aerospace Engineering and a BS in Mechanical Engineering.

The beneficiary s research and development of advanced modules of the finite element based family of software in the area of computational fluid dynamics and heat transfer is a vital contribution to US defense, geological and atmospheric sciences, environmental engineering automotive and other manufacturing industries. The arguments submitted were that the beneficiary s work in this field would save valuable financial resources for US armed forces and benefit a wide range of US industries from food processing to aerospace. Improved health and educational benefits were also argued by showing that the beneficiary s expertise in mechanical and aerospace engineering is critical to the field of biomedical research and will improve the health and working conditions of Americans.

BioModular Research & Analysis

The INS recently approved a National Interest Waiver petition for a Civil/Transportation Engineer in Maryland. The beneficiary, who specializes in biomodular research and analysis, has a M.S. in Science and a BS in Math and Science.

The beneficiary developed a biomodular testing apparatus and biomodular material model that tests the properties of asphalt mixes with modified binder. The arguments submitted were that the beneficiary s work in this field would improve our highways by making them safer and more durable. National Interest arguments included the improvement of the economy based on improved transportation modes utilized by the US and the direct financial savings of millions of dollars to taxpayers.

Structural Systems Research & Analysis

The INS recently approved a National Interest Waiver petition for a Civil/Construction Engineer in Maryland. The beneficiary, who specializes in structural systems research and analysis, has an MS in Civil/Construction Engineering and a BS in Structural Engineering.

The beneficiary's research into the local buckling of pultruded fiber-reinforced plastic beams was proved to be invaluable to the development of durable structural materials for infrastructure rehabilitation and new construction. The arguments submitted were that the beneficiary's work in this field would improve our bridges, buildings and infrastructure by making them safer and more durable. Improved health benefits were also argued by showing that the beneficiary's expertise in abatement of lead and asbestos in key federal construction projects is critical to the health and working conditions of Americans.

The INS approved a national interest petition for an artist in Snowmass, CO. The beneficiary is an artist whose work with art and computers offers new ways of creating and disseminating art. National interest arguments included contributions to the cultural interest of the US in Europe and South America, building cross cultural bridges, improving US education and youth programs and improving our environmental consciousness and economy by making our art work more accessible and more valuable to European and South American artists and art institutions.

Biomedical Engineer :
Virtual Reality Surgical Simulation

The INS approved a national interest petition for a Biomedical Engineer. Beneficiary has a Ph.D. in Biomedical Engineering. The beneficiary's work involves the identification of promising technologies at government entities (DOE, NASA, DOD, etc.) and defense contractors, and facilitating the assimilation of such technologies into the Medical Rehabilitation Model to benefit individuals with disabilities. The beneficiary's research focuses on Virtual Reality (VR) simulation technology in diagnostic, therapeutic, and educational applications to facilitate rehabilitation of individuals who have suffered neurological illnesses and injuries.

In the area of VR, the beneficiary developed innovative VR interface paradigms and coupled these to hitherto under-utilized modeling strategies to enhance the quality of VR. Potential applications of this technique in health-care include surgical simulation (to stimulate tissue palpation), surgical training and education, and restoration of feeding for the handicapped. Non-invasive instrumentation developed by the beneficiary provides patients with audio-visual feedback during therapy.

The INS approved a National Interest Waiver petition for a Post Doctoral Research Fellow. The national interest argument was based on the beneficiary's outstanding, original Anesthesia and Perioperative Medicine research. The research promises to be of great future benefit to US health care, while at the same time improving the economy and the working conditions, education and other programs of US workers.

The beneficiary holds medical degrees and possesses advanced training, with over ten (10) years of experience in the field of anesthesia. The beneficiary devised alternative, improved methods of protection for the heart during surgery and has contributed to the knowledge of cardiothoracic surgery and anesthesia.

The beneficiary has made significant contributions to the field of immunology and the understanding of the pathogenesis of autoimmune diseases. Knowledge that can lead to the control/prevention of autoimmune diseases will have a major impact on improving the nations health care and well being, as well as eliminating millions of dollars of medical expenditures. The Service Center recently approved a national interest waiver for a Material Science Engineer and Researcher in Washington State argued and submitted by the Law Office of Sheela Murthy on behalf of the beneficiary. The beneficiary, who specializes in conductive composites, has a Ph.D., an MS, and a B.S. in Chemical Engineering. It was argued that the beneficiary's advancements in the field of conductive composites would be invaluable to the replacement of traditional conductive materials, namely metals, which may in the future become a limited natural resource. It was argued that the petition was in the national interest based on the obvious benefits of his research work to the environment and economy of the United States.

The beneficiary’s work is highly commendable based on his dedicated research achievements attained for advancement of biotechnology, particularly in bio-energy production from renewable biomass.  It was argued that the beneficiary’s work in this field is critical to the United States due to the increased threat of fossil fuel depletion, and the United States’ interest in developing environmentally friendly and economically sound fuel alternatives.  National Interest arguments focused on how the beneficiary’s research would  reduce foreign oil imports, reduce carbon dioxide in the atmosphere, and better the environment and health of the United States as a whole.

The approval was based on arguments submitted by the Law Office of Sheela Murthy, P.C. emphasizing the beneficiary’s contributions to the cloning and sequencing of genes related to congenital heart defects in children and cystic fibrosis.  It was argued that these contributions have been central to the ongoing research efforts of scientists and researchers across the United States and the world.  National interest arguments focused on the significant improvement of national health and economy due to the beneficiary’s research, as the beneficiary’s unique and pivotal research will continue to enhance the understanding of the causes of many diseases.

Environmental Chemist :
Fossil Fuel Refining

Our office had summarized this case earlier this year since this was a reversal of a NIW decision filed by another attorney and the Law Office of Sheela Murthy obtained an approval in this appeal. The United States Department of Justice, Administrative Appeals Office, reversed the decision to deny a National Interest Waiver for an Environmental Chemist. This decision represents another achievement of the Law Office of Sheela Murthy, P.C. since it is one out of only four appellate cases reversed by the AAU in 1998!

The beneficiary, who specializes in catalytic use in petroleum and other fossil fuel refining, quality control, risk management and remediation, has two Masters Degrees in Chemistry and Environmental Management, a Doctorate Degree in Chemistry, and has completed post-doctoral studies in Public Policy and Management with a concentration in Environmental Policy.

The approval was based on arguments presented by the Law Office of Sheela Murthy, P.C., emphasizing the beneficiary’s contributions to the development and dissemination of cutting edge research in the field of environmental chemistry and education, as being invaluable to the environmental goals of the United States as we enter the 21st century.

Soil Remediation Process

The INS recently approved a National Interest Waiver by the Law Office of Sheela Murthy for medical researcher, whose work in the intertwined areas of Endocrinology, Neuro-endocrinology, Neurology, Metabolism, and Neuro-metabolism has made important advances in the areas of diabetes and cancer research. Approval of his petition ensures that he will continue to make unprecedented contributions to the field.

The beneficiary had been described by leading experts in the field as the foremost researcher in this field. As proof, he submitted a total of 18 reference letters, many from independent experts. He submitted evidence of 20 original publications, of which he is first author on 9 of the articles. The beneficiary's primary research area was wireless communication, involving multiple antenna systems, modulations, error correction coding and decoding, radio propagation, and advanced signal processing algorithms. Industrial Pollution Management

The Nebraska Service Center recently approved a National Interest Waiver for a beneficiary whose innovative research in the area of Industrial Pollution Management in the field of Environmental Science and Engineering was of great significance. His areas of expertise included Industrial Wastewater, Air Emissions, Water Quality Modeling, National Pollutant Discharge Elimination System (NPDES) Permits, and Pollution Prevention and Design, including for wastewater treatment plants, laboratory studies, and pilot-scale plants.

The beneficiary was the first scientist to successfully quantify biodegradation constants for chemical, petrochemical, and pharmaceutical industries. His research provided critical information to substantially aid manufacturing industries in order to provide a cleaner environment. The beneficiary was awarded a Master of Science degree in Environmental Engineering from a leading U.S. university. He is a member of numerous professional organizations and has published several publications in journals and proceedings. The beneficiary has developed numerous methods and innovations, which have been implemented in the field throughout the U.S.
