Consulates Likely to Scrutinize L Visa Applications

The U.S. Department of State (DOS) issued a cable on February 14, 2004 to advise consulates to carefully review L visa applications after the H1B cap has been reached. Indian consulates will likely pay close attention to issues like specialized knowledge of the company or its products and the parent / subsidiary or affiliate relationship between the U.S. entity and the foreign entity to determine the bona fides in any L visa application. In order of L visa usage, India, UK, Japan, Germany, Mexico, France, Brazil, Australia, Venezuela and China have been the highest users of the L visa category in recent years.
