I-129 Approvals Sent to KCC

The United States Department of State (DOS) issued a cable in July 2004
indicating that the USCIS has began sending approved I-129 petitions to the
DOS's Kentucky Consular Center (KCC). Our readers may recognize the KCC as
the location to mail certain diversity lottery application documents. The
KCC will scan the approved I-129 petitions and eMail them to the appropriate
consulates. This process does not apply to I-129F approvals for K-1s and
K-3s, which still will go to the National Visa Center (NVC).

The approval notices will continue to be transmitted to the petitioner or
the petitioner's representative. The transmission of the approved petition
is an internal procedural matter that is relevant to the process of applying
for a visa stamp at the consulate. The transmission will include the
approved petition only, not any supporting documentation. Therefore, persons
applying for visas based on I-129 approvals should remain fully prepared to
present all the necessary underlying documentation in the case.

The DOS expects that this new step will add uniformity and consistency to
the process, which comes as good news to MurthyDotCom and
MurthyBulletin readers. There is as yet no indication of how quickly the
KCC will send the I-129 petition approvals to the consulates once they are
received from the USCIS. Though the KCC will be setting up a Fraud
Prevention Unit that will flag suspicious cases for further consular review,
they will not handle any public inquiries. The consulates remain the correct
contact point for public inquiries on approved I-129 petitions.
