AR-11 Address Change Reminder

When foreign nationals change their addresses, they must file Form AR-11
to notify the U.S. Citizenship and Immigration Services (USCIS) of this
change. The law requires all foreign nationals, including U.S. permanent
residents, to file within ten days of moving. We at the Murthy Law Firm
have seen some indications that the USCIS is tracking AR-11 filings
more closely. MurthyDotCom and MurthyBulletin readers are
reminded of the requirement at this time. Any foreign national who has
relocated to a new address without filing the AR-11 within the ten-day
timeframe should file without further delay.

Use USCIS Website for Online Filing of AR-11

The AR-11 can be filed through a simple,
online system on the USCIS WebSite. It still is also possible to file by
paper, but this does not update the address in connection with any pending
cases. If one files the AR-11 online, there is a prompt for updating the
address in connection with any pending immigration cases.

AR-11 Applies to All Foreign Nationals /
Removable Offense

The AR-11 is required for non-U.S. citizens; this means all nonimmigrants,
as well as U.S. permanent residents (green card holders). As explained in
our January 19, 2007 article,
USCIS Announces Online
Address Notification System, failure to file within the 10-day
window is a removable (deportable) offense.
While no instance
of enforcement action taken solely as the result of missing the AR-11
requirement has come to our attention, the requirement should not be
ignored.

File the AR-11 with Latest Address and File
Promptly in Future

Anyone who may have overlooked filing the AR-11 should file late rather than
not at all. If there have been multiple moves without notification, it is
sufficient to notify regarding the most recent move. Once one becomes aware
of the law, action should be taken to update records with the USCIS, as
needed. It is important to keep records of the AR-11 filing, in the event
that any questions arise.

Conclusion

The AR-11 requirement is often overlooked. While this has been
brought to the attention of our readers in the past, there are many who
still may not be aware of its importance. MurthyDotCom and
MurthyBulletin readers who have forgotten to file, or are only now
learning of the requirement to do so, should not be alarmed. However, they
should take the simple steps to file AR-11 in compliance with the law.
