Overseas Citizenship of India - March 2006 Update

At the Murthy Law Firm, we receive many questions about Indian dual citizenship. Often, our clients are considering U.S. citizenship, but prefer to retain their Indian citizenship for a variety of reasons. Indian dual citizenship is a matter of Indian, and not U.S., law. Therefore, legal advice on this issue must come from a lawyer who practices Indian law. There is some very helpful information, however, on Overseas Citizenship of India (OCI) on the Embassy of India WebSite, which includes instructions on how to apply for the OCI status.

The Murthy Law Firm and its Indian liaison office in Chennai, India, have been following up with the Indian government in New Delhi for more than a year to learn when they plan to release procedures on how certain foreign nationals may apply for OCI. We are now pleased to report that updated information has been provided regarding the process. Many U.S. citizens and certain other nationals at long last can take advantage of this option.

Some stipulations of the OCI program are that such persons cannot vote. They do have some privileges with respect to extended stays in India and in connection with financial, economic, and educational matters. We hope that this information is helpful to those who are considering OCI.
