DOL Functions Officially Reassigned

The U.S. Department of Labor (DOL) issued a notice in the Federal Register on July 7, 2005, reassigning certain functions from the Regional Administrators to the Chief of the Division of Foreign Labor Certification at the DOL. These reassigned functions to the Chief of the Division of Foreign Labor Certification include the H2A and H2B programs, other nonimmigrant DOL responsibilities, and the pre-PERM labor certification adjudication functions.

What Does this Mean for my LC / PERM Processing?

The Chief of Division of Foreign Labor Certification at DOL may delegate these duties as appropriate. Obviously, the Chief of the Division of Foreign Labor Certification will not personally perform these functions, but he is expected to be involved in making important decisions as to these positions. This notice is consistent with the DOL's transfer of pre-PERM cases to the Backlog Processing Centers (BPCs) and efforts to move these nonimmigrant programs into the Atlanta and Chicago DOL centers.

Effect of the Notice

The Notice only changes the ultimate responsibility for processing these cases. It does not alter the standards under which the cases should be reviewed. This is another step toward the complete elimination of the old Regional Centers that processed these types of cases.
