October 2007 Visa Bulletin Predictions

We have just confirmed with the U.S. Department of State (DOS) Visa Office that the DOS Visa Bulletin for October 2007 will likely be similar to the DOS Visa Bulletin for January 2007. The January Visa Bulletin, http://travel.state.gov/visa/frvi/bulletin/bulletin_3100.html, was current for EB1, and EB2 for countries of chargeability other than India and China. The EB2 cutoff for China was April 22, 2005; India was January 8, 2003. EB3 cases were all retrogressed, with cutoff dates ranging from May 8, 2001 to August 1, 2002.

The caveat / warning is that, of course, there is no guarantee that the priority dates in October 2007 will be exactly as they were in January 2007. The DOS stated that it will depend upon information from the USCIS as to case processing expectations. One should not rely on this information as a basis for delaying the filing of her/his I-485 (Adjustment of Status) case. Those who are eligible to file the I-485 before August 17, 2007, should consider filing it; but of course, each person's case will be unique. For example, some people need to and want to delay filing and obtaining their I-485 approvals when they are not yet married and want to ensure that their respective spouses will be able to enter the U.S. in H-4 dependent status.

If the DOS projections are accurate, then it may be of some help to those who are out of the country at this time, or for individuals waiting for action on their Labor Certification (LC) cases through the U.S. Department of Labor Backlog Processing Centers or if the PERM approval is pending. Many of the pre-PERM LC cases have early priority dates and, particularly for EB2, might get some relief in October 2007 if their cases are not approved in time to file with the USCIS before August 17, 2007. This has been a difficult time for people with BPC cases, all which have priority dates of March 2005 or earlier, as they watch others with later priority dates move forward in filing I-485s while they must still must wait.
