NSC Update : Physician NIW Notifications

The Nebraska Service Center (NSC) released information in early July 2004 that it has changed its procedure to receive medical service notifications issued to National Interest Waiver (NIW) physicians who have filed I-485s. In NIW physician cases, the I-485 cannot be approved until the physician has served in a medically underserved area for 5 years. The USCIS requires certain periodic notifications that the physician has completed steps towards this goal. The NSC will be including a pink-colored sheet for each NIW response required. The pink sheet should be returned to the NSC on top of the notification response. The NSC expects that this will enable better tracking of the evidence and of the 5-year period for the I-485. The NSC asks that any physicians who have already completed one year or more of their service in medically underserved areas provide such evidence when filing the I-485 application to adjust status.

The NSC further notes that, if the I-485 is filed concurrently with the NIW I-140 petition, the pink cover sheets will not be sent until I-140 petition has been approved.
