NSC on Resubmitting
Improperly Rejected Cases

The Nebraska Service Center (NSC) has developed a policy on how persons
whose immigration applications or petitions are erroneously rejected should
return these filings to the NSC. This is limited to instances where the NSC
wrongly rejected the entire case for filing and returned it. This is not for
cases that were accepted and denied after review by USCIS examiners.

If a case was rejected in error, it should be sent with a goldenrod-colored
coversheet, on which are the words: "CRU SUPERVISOR" and "Case Improperly
Rejected." Directly under this sheet, should be a brief explanation as to
why one believes the petition or application was improperly rejected. The
NSC will review each request and determine, on a case-by-case basis, whether
there was an improper rejection of the initial filing of the petition or
application.

Such mistakes in case rejections should be infrequent, but can cause serious
problems where there are deadlines involved. We at the Murthy Law Firm
