DOS Proposed Rule to Extend J-1 Au Pair Stay

The U.S. Department of State (DOS) issued a proposed rule on February 2, 2006 pertaining to the J-1 Au Pair Program. An au pair [defined at (http://en.wikipedia.org/wiki/Au_pair)] is a specific class of nanny permitted to come to the United States temporarily through an authorized J-1 sponsoring program. Currently, au pairs under the J-1 program may remain in the U.S. only for one year and must be between the ages of 18 and 26.

The proposed regulation would allow individuals to extend the original year by six, nine, or twelve months. This one-time extension could be helpful for those relying upon au pairs for childcare. It might also serve to enhance cultural exchange, offering the au pairs more time to learn about the U.S.

There is a sixty-day comment period. This proposal for a change in regulation follows a successful pilot program.
