Members of the American Immigration Lawyers Association (AILA) met with the
Texas Service Center (TSC) to discuss topical immigration issues. Highlights
of that meeting of particular interest to our MurthyDotCom and
MurthyBulletin readers follow.

H1Bs Sent to TSC are Processed

It was reported that the Vermont Service Center (VSC) transferred 20,000 H1B
petitions to the TSC for processing. Indications are that all of these cases
have been processed, meaning that an approval, denial, Request for Evidence
(RFE), or Notice of Intent to Deny (NOID) has been issued. Some of these
cases have not reached a final decision, as RFE and NOID response processing
has not been completed.

Checks Must Have Words, Not Numbers

The TSC
rejected a check on which the written amount indicated "Exactly $170 and 00
cts." The TSC said that it will continue to reject checks with numbers on
the line where the amount should be written out in word form. The purpose of
the spelled-out, word format is so that the bank can confirm the amount for
which the check is intended, so it is safest to be meticulous about this,
since a rejection of the package could result in one's not being considered
in valid legal status.

Signature Must be in Correct Box

A petition was rejected because the petitioner signed the form in the date
box rather than the signature box. Historically, the TSC has accepted
petitions with the signature in the wrong place, as long as the signature
appeared on the petition. The TSC has now stated, however, that it will not
accept a petition unless the signature is in the correct box or space on the
form. Problems may result in matters that are time sensitive, if a
petitioner makes this mistake.

Check Green Card for Correct Country of Birth /
Citizenship

Some green cards are approved with French Polynesia designated as the
country of birth or citizenship when the country should be Austria or
Australia. At the Murthy Law Firm, we recommend that individuals born in
these countries, or who are citizens of these countries, pay particular
attention to the country listed when the green card is received, since an
improper entry could cause difficulties later.
