The latest USCIS H1B cap announcement, issued May 15, 2006, shows a remarkable increase in H1B cap-subject filings. The USCIS reports that 18,071 standard cap cases were filed between April 28, 2006, and May 12, 2006. This increases the level of filings to 34,808 standard H1B cap-subject cases filed. This represents an average of approximately 1290 filings per day between the last count, on April 28, 2006, and the current count. The advanced degree cases increased in the same period by 1754, to a total of 4,638 masters' cases filed, which is an average of approximately 125 cases per day.

If this case filing rate continues, the standard H1B cap could be met in early June 2006, and the advanced degree cap could be met in September 2006. We at the Murthy Law Firm believe that it is a real possibility that this pace will continue, particularly for the standard H1Bs, now that we are in prime college graduation season. Any person who is eligible to file should do so immediately to avoid missing the cap and then having to wait until October 1, 2007 to work in H1B status in the U.S.
