It is no longer possible to use premium processing for I-140 Employer Petitions in cases requesting substitution of beneficiaries. The termination became effective on May 18, 2007 as a result of the Department of Labor (DOL) regulation terminating labor substitution cases. Since labor substitution cases will end on July 16, 2007, the USCIS is anticipating a large volume of substitution filings and will not be able to provide premium processing services for those cases. All other premium processing services remain unchanged.
