NewsFlash! Heavy H-1 Filing Rate : Cap Very Close

The USCIS has, yet again, provided an updated H-1 cap count. The latest
information was released on May 30, 2006. The May 30th
information provides the count through May 25, 2006. The new information
reflects that between, May 23rd and May 25th, there
were 3884 cases filed against the H1B cap. This raises the number of cases
filed toward the standard H1B cap to 49,034. These numbers translate to a
remarkable average of approximately 1942 filings per day for the latest
two-day reporting period. This means that the standard cap could be met
within days. Therefore, those with cases to be filed need to act quickly.

The advanced degree cases increased during this same period by 275 cases,
bringing the total to 5,830 advanced degree cases filed. This is an average
of approximately 137 cases per day. If the advanced degree cases continue at
the rate experienced in this most recent period, the cap could be met as
early as mid-August. The previous predictions estimated that it would be met
in September or October. Time will tell if the level of filings continues at
its current rate. The increase may be due to the May 2006 U.S. graduates.

MurthyDotCom, the standard cap is 58,200 available numbers for the
general public, with 6,800 additional numbers set aside under trade
agreements with Chile and Singapore. There are 20,000 cap exemptions allowed
under the advanced degree cap for persons with U.S. masters' degrees or
higher U.S. degrees.
