My passport expires in less than two years. If I apply for a visitor visa now, will it still be issued with a validity period of 10 years?

I have a valid H1B visa “stamp” in my passport. If I apply for an L1A visa, will that cause the consulate to cancel the H1B visa?

Answer In general, applying for one type of visa should not cause a consular officer to cancel a different visa in one's passport. However, this does sometimes happen. (08.Oct.2018)In frequent sessions of our Chat, Sheela Murthy and other senior attorneys provide guidance that clarifies the law...

I applied for an H1B visa stamp in India, but the consulate sent it for administrative processing, which has been pending for about a month. Now I have a job offer from a different employer. Can I transfer my H1B to new company and go for stamping once the new petition gets approved?

Answer It normally would be possible to schedule a new interview based on the new approved H1B petition. One likely would be required to withdraw the pending visa application, however. My OPT expires in June 2019, and I am being sponsored for an H1B cap case this year. I need to travel to India at the end of April for a couple of weeks. Will that impact my H1B?

Answer Very likely, the H1B filed in April could be approved only for consular processing, not for a change of status. This means that, assuming the H1B case is selected in the lottery and approved, one in this situation would probably need to depart the U.S....

My H1B visa was refused by the consulate because they had concerns related to my employer’s right to control my work. My wife is in the U.S. working in H1B status. Can I now apply for an H-4 visa?

Answer Generally speaking, being denied issuance an H1B visa would not prevent a person from qualifying for an H-4 visa. (13.Nov.2017)In frequent sessions of our Chat, Sheela Murthy and other senior attorneys provide guidance that clarifies the law in real time. For details on chat participation,...
