H1B Cap Case Update as of May 7, 2013
10 May 2013The U.S. Citizenship and Immigration Services (USCIS) is still processing H1B cap-subject filings for fiscal year 2014 (FY14), as of this writing. Questions regarding the status of these filings continue to come into the Murthy Law Firm. This NewsBrief updates MurthyDotCom readers on the process, over which many still are anxious.
H1B Receipts, Approvals, and RFEs
The Murthy Law Firm continues to regularly receive approval notices for FY14 cap-subject cases, mostly for cases that were filed under the premium processing option, but also for some cases that were filed using regular processing. The regular and premium processing approvals to date are for cases that did not receive RFEs.
Still, most of the cases filed using regular processing remain pending with the USCIS. We continue to receive receipt notices in the mail, and have received requests for evidence (RFEs) for some of these filings.
No H1B Rejection Packets Yet at Murthy Law Firm
To date, we at the Murthy Law Firm have had no filings returned for cases that were not selected in the H1B cap lottery. As explained in our NewsBrief, H1B Cap Selection Update as of April 23, 2013, the USCIS is expected later this month to begin sending back petitions that were not selected in the random lottery, and therefore not selected for processing.
Conclusion
Although most interested parties now know whether their respective cases were selected in the FY14 H1B lottery, there is still some hope for those who still awaiting notification. The MurthyDotCom readers can expect more information on H1B cap filings in the coming weeks.
