Can I change job location only while staying with the same employer after getting my green card?

Answer:

This depends upon the wording of the labor certification, as green cards are based upon future job offers to take effect upon approval of the GC. So, the expectation is that the individual will work in that job for a reasonable time after approval. Some PERM LCs are location specific, others have flexibility to work at “various unanticipated locations.” If the labor has flexibility on locations, the location could change without any impact. If the labor is not as flexible, it would be best to try to limit such moves during the time immediately after the GC approval. Otherwise, if a move is desired and the GC has not yet been approved, consider using the AC21 portability provisions to permit the move. (16.Dec.2013)
