Is it legal to file for H1B through multiple employers?

Answer:

Yes, it is possible for an individual to be the beneficiary of multiple H1B petitions simultaneously. This often happens due to the uncertainty of the H1B cap. It may also happen when there is a job loss and one accepts a job and, then receives a better job offer. It is also possible to have concurrent H1B petitions through multiple employers, allowing employment with more than one employer at the same time. Keep in mind that the petitions must identify that they are for concurrent employment and specify whether they are full time or part time (and the number of hours to be worked). It is important to be mindful of the terms of the agreements one signs with employers prior to the H1B filings, if promises are being made to or by the employer. (13.Jan.2014)
