Can I continue to work on L-2 EAD status even after October 1st, provided my H-1 petition filed this year gets approved?

Answer

If the H1B is approved for October 1 with a change of status, then the status changes to H1B. Thus, a person in this situation is no longer an L2 and can’t work on their EAD. If the change of status is not desired, there are options to resume L2 or avoid the change. But, it is not permissible to fail to act and try to ignore the COS. (31.Mar.2014)
