My company is applying for my I-140. In required docs, the employer is insisting that I provide all my W-2s – starting from the 1st one, through the one I received last year. Is it mandatory requirement at this stage?

Answer

The issue in the I-140 is that the company has to show the ability to pay the offered wage set out in the PERM labor. One good way to show that the company can pay someone is if the company has already been doing so. Thus, it is common to include the W-2s from that particular sponsor. It is not clear why they would include W-2s with any unrelated employer. (19.May.2014)
