I applied for reinstatement to F-1 status in January this year. I took a full course load in the Spring semester, which is now over and my application is still pending. May I take the summer vacation without jeopardizing my reinstatement request?

Answer

A student who applied for reinstatement must be “currently pursuing, or intending to pursue, a full course of study in the immediate future at the school which issued the Form I-20.” Generally, students in F-1 status still would be considered to be maintaining a full course of study even if they take the annual (i.e. summer) vacation, as long as they intend to enroll again in the next academic term. Since you were pursuing a full course of study once you applied for reinstatement, and you intend to continue your full-time enrollment in the next available term after the annual summer vacation, you should be able to take the summer off as this should not break your full-time status.
