NewsFlash! Publication of Proposed Rule for Certain Foreign National Entrepreneurs Expected Soon!

On August 24, 2016, the Office of Management and Budget (OMB) concluded its review of a proposed rule designed to allow the U.S. Department of Homeland Security (DHS) to parole (i.e. grant temporary permission to enter the United States to) “…inventors, researchers, and founders of start-up enterprises who may not yet qualify for a national interest waiver, but who have been awarded substantial U.S. investor financing or otherwise hold the promise of innovation and job creation through the development of new technologies or the pursuit of cutting edge research.” The proposed rule, which is entitled “Significant Public Benefit Parole for Entrepreneurs,” will likely be published in the Federal Register in the very near future.
