NewsFlash! H1B Cap Lottery Completed for FY 2019

Today, the U.S. Citizenship and Immigration Services (USCIS) announced that it has completed the randomized H1B cap lottery selection process. The USCIS reported that it received 190,098 petitions this year, which is a slight reduction from the 199,000 H1B petitions received last year, and is the lowest number of cap cases filed in the last six years.  As is normal, the USCIS did not provide a breakdown of how many of these petitions were eligible for consideration under the advanced-degree exemption (“master’s cap”), and it is not expected to do so.

The USCIS conducted the lottery selection for the master’s cap first. Cases filed in that category that were not selected in the master’s cap were included in the regular cap lottery selection. Any cases that were not selected will be returned to the petitioner with filing fees. We will post more information on MurthyDotCom as it becomes available.

Update on H1B Lottery

Surprisingly, the USCIS has released a breakdown of the H1B cap numbers, specifying how many were filed under the master’s cap. Of the 190,098 petitions filed, 95,885 were filed as being eligible for the master’s cap. Cases not selected in the master’s cap lottery were then placed in the regular H1B cap lottery for possible random selection.
