NewsFlash! Aug 19 Deadline for H1B Amendments for Employee Relocation

Employers who are required to file amended H1B petitions due to employee worksite changes must do so by August 19, 2015. USCIS guidance, issued May 21, 2015, interprets H1B amendment requirements in light of a recent Administrative Appeals Office (AAO) decision, Matter of Simeio Solutions, LLC.

A key component of the USCIS guidance is a ninety-day deadline for employers to file the required amendments. Employers who do not take the needed steps by August 19, 2015 will be subject to adverse action. Employees of noncompliant companies will be considered to be out of status. Thus, it is vital for employers to file amended petitions, if required.
