I am working based on my L-2 EAD, but my husband’s 5-year max out of L1B time is next month. Does this max out date apply to me as well? Or, can I keep working on L-2 EAD until I reach 5 years?

Answer

An L-2 spouse is not subject to the 5-year time limit. But, one cannot be in L-2 status if there is no L-1 principal. So, once the principal worker runs out of L-1 time, the dependent spouse can no longer maintain L-2 status (or use the corresponding L-2 EAD). (15.Feb.2016)
