NewsFlash! Revised STEM OPT Rule Undergoing Final Review

On February 5, 2016, the U.S. Department of Homeland Security (DHS) submitted the proposed revisions to the STEM optional practical training (OPT) program to the Office of Management and Budget (OMB) for final review. Once this review is complete, the last step would be to publish the final rule in the Federal Register. Expectations are that the final rule will be published by March 10, 2016 and have an effective date of no later than May 10th, the date the current STEM OPT program is scheduled to terminate, as reported in NewsFlash! STEM OPT Extended (25.Jan.2016). Whether any changes were made to the initial version of the proposed rule – which is discussed in the MurthyDotCom NewsBrief, New STEM OPT Proposed Regulation Published (20.Oct.2015) – will likely not be known until the final rule is published. Once this occurs, Murthy Law Firm attorneys will review and analyze the final rule.
