My H1B was picked in the 2016 lottery, but the case was denied. Can a different employer sponsor me now, without having to go through the lottery again?

Answer

A person is not considered to have been counted against the H1B cap based on an H1B petition that is selected in the lottery but never approved. Generally speaking, in that situation, the person would need to go through the lottery process again. (17.Apr.2017)
