NewsFlash! USCIS Resumes Premium Processing for FY19 Cap Subject H1B Petitions

The U.S. Citizenship and Immigration Services (USCIS) has announced that, beginning Monday, January 28, 2019, premium processing will resume for all fiscal year 2019 (FY19) H1B cap cases, including the advanced degree exemption “master’s cap” cases. Premium processing provides a guarantee that the USCIS will take some adjudicative action on the H1B petition within fifteen (15) days of submission of the Request for Premium Processing Service (form I-907), or the premium-processing fee is refunded. This action can be a decision or the issuance of a request for evidence.

The USCIS has stated that premium processing will remain suspended for all other H1B petitions, which were previously made subject to suspension until further agency resources become available.
