NewsFlash! USCIS Resumes Premium Processing for Certain H1B Petitions

The U.S. Citizenship and Immigration Services (USCIS) announced today that, beginning Tuesday, February 19, 2019, premium processing will resume for all H1B petitions filed on or before December 21, 2018. Premium processing provides a guarantee that the USCIS will take some adjudicative action on the H1B petition within fifteen (15) days of submission of the Request for Premium Processing Service (form I-907), or the premium-processing fee is refunded. This action may be a decision or the issuance of a request for evidence.

With this announcement, the USCIS is expanding the types of H1B cases that now will be accepted for premium processing services. Cases that previously were made subject to the premium-processing suspension, and were filed after December 21, 2018, remain ineligible for premium processing until further agency resources become available.
