NewsFlash! USCIS Resuming Availability of Premium Processing for All H1B Petitions

The U.S. Citizenship and Immigration Services (USCIS) announced today that, beginning Tuesday, March 12, 2019, premium processing service again will be made available for all H1B petitions. Premium processing provides a guarantee that the USCIS will take some adjudicative action on the H1B petition within fifteen (15) days of submission of the request for premium-processing service (form I-907), or the premium-processing fee is refunded. This action may be the issuance of a decision or a request for evidence.

Today’s announcement does not mention how premium-processing service may be implemented for cap-subject H1B petitions for fiscal year 2020 that will be filed during the first week of April 2019 (i.e., the H1B lottery). Most years, the USCIS makes premium processing available for H1B lottery filings, but delays the start of the 15-day processing period by at least several weeks.
