My employer will not provide me with a copy of my I-140 approval. Can I get this document by filing a FOIA request?

Answer

If you file a FOIA request, the USCIS may not provide you with a copy of the actual approval notice; but, the USCIS typically will at least provide the beneficiary with related documents that contain all the important information one would find on the actual I-140 approval notice. One generally can use these documents, rather than the approval notice, to request that the priority date be transferred to a different PERM case or to use the I-140 as a basis to extend H1B status.
