… The DSO reviewed the I-983 and issued me a new I-20 with the STEM OPT recommendation that I submitted with my application. I have now received a new offer of employment from another company. Am I allowed to change to a new company while my STEM OPT application is still pending?

Answer

Yes, you can move to a new employer who is registered in E-Verify and who completes a new Form I-983 with you. You must provide the new Form I-983 to your DSO who will use it to update your SEVIS record. No new application is required.

You become subject to all the obligations and requirements under the STEM OPT rule after the expiration of your first-year OPT EAD, even if your STEM OPT application is still pending.   These requirements include an obligation to complete a self-evaluation form based on the Form I-983 with your previous employer.
