I timely applied for post-completion optional practical training (OPT) for students in F-1 status. …

… However, it has been several months since the requested OPT start date and my application is still pending after the USCIS issued a request for evidence (RFE) on my case and I responded to it. Should I be concerned that the time I remain unemployed post the requested start date will be counted against the 90-day unemployment limit?

Answer

The “clock” for unemployment does not start until the USCIS approves your application and issues an OPT EAD. (05.Jan.2018)
