I am on STEM OPT and had to go to India for a family emergency. Can I work in my STEM OPT position from India?

Answer

A number of special allowances have been made due to the ongoing pandemic. One such allowance is that foreign nationals engaged in OPT or STEM OPT are permitted to work remotely from outside the United States if the employer has an office outside of the U.S. or if the employer can assess student engagement electronically. If either requirement is met, the person’s SEVIS record can remain active and such work will not count as a period of unemployment. (12.Jan.2022)
